Qualcuno potrà chiedersi, ma perché parliamo di arringhe di avvocati americani? Perché quello americano è un sistema che incentiva gli avvocati migliori dal punto di vista processuale ed è per questo che ha dato la nascita ad avvocati con caratteristiche comunicative e persuasiva eccellenti (ad esempio Gerry Spence non ha mai perso una causa penale in tutta la sua carriera: dato di cui i più diffidenti possono trovare molte conferme con una semplice ricerca su google).

Ciò è influenzato almeno da tre ordini di ragioni di sistema (assenti in molti altri sistemi come, per l’appunto, quello italiano): la prima ragione è che i cittadini ed i colleghi avvocati, negli Stati Uniti, conoscono le percentuale di successo processuale di un avvocato (oggi il dato è addirittura accessibile online da chiunque in pochi secondi) e, quindi, trattandosi di un aspetto che si riflette in maniera diretta sulla propria reputazione e considerazione da parte della società, nasce un incentivo fortissimo a diventare il miglior avvocato che si è in grado di essere (e nessuno può nel contempo nascondere al pubblico, come ahimè avviene in altri sistemi, la propria incompetenza); in secondo luogo, questo stesso fattore (l’esito dei giudizi seguiti) viene considerato favorevolmente ai fini carrieristici sia in ambito privato sia in ambito pubblico, chi vince la cause fa carriera in pratica; in terzo luogo, la parcella dell’avvocato nelle cause riguardanti un risarcimento viene parametrata su una percentuale del risarcimento stesso, quindi l’avvocato ha tutto l’interesse, anche personale, a vincere (ed a stravincerle negli importi).

La scala dell’eccellenza progredisce nei sistemi che integrano verifiche ed incentivi. Come d’altronde avviene in ambito sportivo. Molti sono i momenti storici in cui uno sportivo ha raggiunto un traguardo che prima di allora si riteneva “impossibile” a livello di prestazioni umane, e ciò è sempre accaduto all’interno di sistemi (es. preparazione ai giochi olimpici, sportivi professionisti) che incentivano l’eccellenza, con il riconoscimento personale e sociale (es. medaglia d’oro olimpica) ed i premi in denaro. Mentre al di fuori di questi sistemi di incentivazione, ad esempio al di fuori di chi compete per le olimpiadi o come professionista, non vi sarà mai un pari livello di eccellenza perché semplicemente il sistema non lo verifica né incentiva.

Io dal mio personalissimo punto di vista, ho sempre cercato di operare “come se” fossi in un sistema che premia l’eccellenza, che incentiva i migliori, segnando e tenendo sempre con me un file con ogni singolo risultato processuale, che rispecchia in maniera chiara e semplice i miei risultati di un dato anno. D’altronde, dice un vecchio adagio, quando si tengono i punti la partita la si gioca molto meglio.

Esaminiamo quindi la prima parte dell’arringa conclusiva sviluppata da Gerry Spence contro la centrale nucleare Kerr-McGee Corp, che ha da ultimo condotto ad un risarcimento eccedente i dieci milioni di euro per la morte della signorina Karen Silkwood. Vediamo la prima parte.

MR. GERRY SPENCE, Esq., delivered the plaintiff’s CLOSING ARGUMENT.

Thank you, Your Honor.

Well, here we are.

Every good closing argument has to start with “Ladies and Gentlemen of the Jury,” so let me start that way with you. I actually thought we were going to grow old together.

(Questa parte è fondamentale. È il “frame” di partenza. Gerry Spence non racconta la vicenda “ai” giudicanti / giurati, ma guarda la vicenda insieme ai giudicanti / giurati. Questo è fondamentale per il “leading” che seguirà. Prosegue da qui costantemente con l’utilizzo del noi al fine di creare un senso di unione.

I thought we would just kind of go down to Sun City, and get us a nice complex there and sort of live out our lives. It looked like that was the way it was going to happen. I had an image in my mind with the judge at the head block, and then the six jurors with nice little houses beside each – and I hadn’t made up my mind whether I was going to ask Mr. Paul [a lead lawyer for Kerr-McGee] to come down or not – but I didn’t think this case was ever going to get over and I know you didn’t think so, either.

(Altra parte importante. Qui Gerry Spence ottiene il primo “si, è vero”, che, per effetto del c.d. “consistency bias”, principio che, come spiega ampiamente Cialdini ed i numerosi studiosi che hanno seguito, svolge un ruolo determinante nell’ambito delle decisioni umane, principio che da qui costituirà un primo parametro per ancorare le decisioni a seguire).

And, as a matter of fact, as Mr. Paul kept calling witnesses and calling witnesses, I sort of got the impression that he’s fallen in love with us over here and just didn’t want to quit calling witnesses.

Ladies and gentlemen, it was winter in Jackson, Wyoming, when I came here, and there was four feet of snow at Jackson. We’ve spent a season here together. I haven’t been home to Jackson for two and a half months. And, although I’m a full-fledged Oklahoman now, and have been for over a month and a half, nevertheless I’m homesick. And I’m sure you’re homesick, too. I’m sure this has been a tough one on you. Well, I know lots of you have had to do extra work, and I know you’ve had to work at night, and I know you’ve had to drive long distances.

Spence separa i ruoli cercando di accostare la propria posizione a quella dei giurati. Comprende che il processo è stato lungo ed estenuante per i giurati e rimarca questo aspetto dicendo qualcosa che tutti i giurati condividono. Prosegue con una serie di frasi che presuppongono la risposta positiva dei giurati (fondamentale dal punto di vista psicologico, vedi consitency bias di cui alla precedente nota).

L'altro aspetto importante di questa parte è che introduce “il cattivo”, puntando il dito all’altra parte alludendo al fatto che il processo è andato per le lunghe perché l’avvocato di controparte continuava a chiamare testimoni. Cerca dunque di creare due team: quella dei giurati e di Spence, da un lato, e quella di controparte, del cattivo, dall’altra parte.

Every morning – now, I’m a jury watcher – you watch me watching you every morning, and I’d look at you to see if my jury was all right, and see if they were feeling okay. Sometimes they weren’t feeling too good, but mostly we made it through this matter together, and I’m pretty proud of that. It’s the longest case in Oklahoma history, they tell me.

Alla fine, lo dice espressamente lui e i giudicanti / giurati sono insieme in questo.

And, before the case is over, you will know, as you probably already know, that this is probably the most important case, as well.

Well, ladies and gentlemen, I want you to know that I don’t know how – excepting because Bill Silkwood happened to want me – a country lawyer from Wyoming got out to Oklahoma. It sort of seems that if anything good comes out of this trial that it was providence, and it’s the most important case of my career. I’m standing here talking to you now about the most important things that I have ever said in my life. And, I have a sense that I have spent a lifetime, fifty years, to be exact, preparing somehow for this moment with you. And, so, I’m proud to be here with you, and I’m awed, and I’m a little frightened, and I know that’s hard for you to believe because I don’t look frightened. But, I’ve been frightened from time to time throughout this trial. I’ve learned how to cover that up pretty well. And, what I am setting out to do today is frightening to me. I hope I have the intelligence, the insight, and the spirit, and the ability, and just the plain old guts to get to you what I have to get to you. What I need to do is to have you understand what needs to be understood. And, I think I’ll get some help from you. My greatest fear in my whole life has been that when I would get to this important case – whatever it was – I would stand here in front of the jury and be called upon to make my final argument and suddenly you know, I’d just open my mouth and nothing would come out. I’d just sort of stand there and maybe just wet my pants, or something.

Questa parte ha un impatto enorme. Qui, emerge la cosa più importante, quella che negli insegnamenti classici si chiama ethos. La credibilità. Gerry Spence confida ai giurati qualcosa di segreto, dice che ha un po' di paura. Ed ecco che tutto di un tratto si veste del manto che nei tempi moderni ha fatto la fortuna dei più famosi youtuber (quelli seguiti da milioni e milioni di persone al mondo e che influenzano le masse): l’autenticità. È anche abbastanza avveduto da anticipare l’obiezione (“non sembri impaurito”) e replicarvi.

Dunque Gerry Spence dimostra onestà e autenticità, con un bel check sulla casella “ethos” (negli insegnamenti classici ethos, logos, e pathos sono le 3 componenti della persuasione perfetta).

Fino ad ora, notiamo, Gerry Spence (che, se non ha mai perso un processo penale in tutta la sua carriera, ci sarà un motivo) neanche parla della causa ma si concentra su 3 punti:

- senso di comunione / unione – annullamento di qualsiasi contrapposizione. Siamo qui insieme.

- priming del “siamo d’accordo”, introdotto con molte frasi condivisibili. Che funziona attraverso il consistency bias.

- condivisione di un segreto per apparire autentico.

Solo ora si incomincia a parlare della causa.

But I feel the it juices – they’re going, and I’m going to be all right.

Well, what we’re going to talk about here isn’t hard. If a country lawyer from Wyoming can understand it – if I can explain it to my kids – if Mr. Paul can’t understand it – and his kids – then we all can understand it. “What’s going on, and who proves what?”

Well, we talked about “strict liability” at the outset, and you’ll hear the court tell you about “strict liability,” and it simply means: “If the lion got away, Kerr-McGee has to pay.” It’s that simple that’s the law.

Gerry Spence che fino ad ora neanche aveva parlato della causa, sgancia la prima bomba argomentativa. Qua s’intrecciano diverse tecniche: 1) metafora (per alcuni, che considerano metafore solo linguaggio figurato, sarebbe un’analogia), 2) riduzione, 3) semplificazione totale, 4) etichetta / frame della causa. Vediamo come il collega avvocato la sviluppa.

You remember what I told you in the opening statement about strict liability? It came out of the Old English common law. Some guy brought an old lion on his ground, and he put it in a cage and lions are dangerous and through no negligence of his own through no fault of his own, the lion got away. Nobody knew how like in this case, “nobody knew how.” And, the lion went out and he ate up some people and they sued the man. And they said, you know: “Pay. It was your lion, and he got away.” And, the man says: “But I did everything in my power I had a good cage had a good lock on the door I did everything that I could I had security I had trained people watching the lion and it isn’t my fault that he got away.” Why should you punish him? They said: “We have to punish him we have to punish you you have to pay.” You have to pay because it was your lion unless the person who was hurt let the lion out himself.

That’s the only defense in this case: unless in this case Karen Silkwood was the one who intentionally took the plutonium out, and “let the lion out,” that is the only defense, and that is why we have heard so much about it.

Strict liability: “If the lion gets away, Kerr-McGee has to pay,” unless Karen Silkwood let the lion loose. What do we have to prove? Strict liability. Now, can you see what that is? The lion gets away. We have to do that. It’s already admitted. It’s admitted in the evidence. They admit it was their plutonium. They admit it’s in Karen Silkwood’s apartment. It got away. And, we have to prove that Karen Silkwood was damaged. That’s all we have to prove. Our case has been proved long ago, and I’m not going to labor you with the facts that prove that. It’s almost an admitted fact, that it got away, and that she was damaged.

Quindi, ricapitolando, Gerry Spence usa una metafora per semplificare, e per stabilire il frame / l’etichetta / l’oggetto del giudizio. Gerry Spence ha ridotto tutto alla domanda: “gli altri hanno provare che è stata proprio la persona danneggiata a far uscire il leone?” (nel caso di specie che la lavoratrice della centrale nucleare si è infettata da sola) perché se non l’hanno provato devono dare ragione a lui / alla pretesa dell’assunto danneggiato.

Does Silkwood prove how the lion got away? You remember this – Mr. Paul walking up to you and saying, at the beginning of the trial, listen, it’s important to find out how the lion got away.” Well, it is important, because they have to prove how but we don’t. And the court will instruct you on that. As a matter of fact, I think you will hear the court say exactly this, and listen to the instruction: It is unnecessary for you to decide how plutonium escaped from the plant how it entered her apartment or how it caused her contamination, since it is a stipulated fact stipulated between the parties that the plutonium in Silkwood’s apartment was from the defendants’ plant.

Qui, possiamo intravedere la forza dell’associazione con la posizione del giudice: il messaggio tra le righe è che “anche il giudice la pensa come me”. Poi che sia su tutto o solo su quel punto non è approfondito.

So, the question is: “Who has to prove how the lion got away?” “They have to prove it.” They have to prove that Karen Silkwood carried it out. If they can’t prove that by a preponderance of the evidence, they’ve lost. Kerr-McGee has to prove that. Why? Well, it’s obvious. It’s their lion not Karen Silkwood’s lion. It’s the law. It’s that simple.
